Per Garrett County Planning and Zoning, it qualifies as a residential building lot if it is approved for septic system by the Health Department. Per the Health Department, “Being that the septic permit is from 1958 and with the home being torn down, this office would require a percolation test to be conducted to determine if a dwelling can be built in this location. There would need to be enough room for a sewage disposal system and a backup area. Plus, the sewage disposal area would need to be at least 100’ from the existing well or have the current well be abandoned by a well driller and a new well drilled meeting the 100’ requirement”. All zoning and use determinations will be made by Garrett County, Maryland. State Highway Administration (SHA) offers no warranty as to zoning or permitted use. • SHA considers the highest and best use of the subject property is for development as a residential property. • The property is accessible via MD Route 135 (Maryland Highway). The property will be sold subject to 0.095-acre perpetual easement for ingress and egress to the adjoining property owner (Deer Park Sportsmen’s Club, Inc.). A portion of the property to be conveyed crosses into a driveway that the adjoining owner uses to access their property.
