A legal nonconforming use is one that was legally established in the past, but which is no longer in conformance with the subsequently adopted land use ordinances. The legal non-conforming use is “concrete and asphalt recycling” as per SMP00198S1. This legal nonconforming use may continue for a period of forty years or until February 9, 2057. It should be noted that a ten-year extension is available for legal nonconforming use. (18.8.D) A legal conforming use may lost if the use is expanded or abandoned.
